Terms & Conditions

In these Booking Conditions, any reference to “you” and “your” means all persons named on the booking form (including any person added or substituted upon notification in writing to us at a later date). “We”, “us” and “our” means Costameiga, Pino de Val, 3, 15256 Mazaricos, registered in Spain.

1. YOUR BOOKING

Once we have received the deposit we will confirm the receipt of payment. Please check these details carefully and contact us immediately if there are any discrepancies. Your contract with Costameiga is made once we have received the deposit and the invoice has been raised.

The person who signs the booking form must be 18 years or over. The signatory certifies that he/she is authorised to agree the Booking Conditions on behalf of all persons named on the Booking Form, including those substituted/added at a later date.

Costameiga itself or on behalf of the Property Supplier/Service Provider(s) (as applicable) has the right to refuse any booking prior to the issue of your written confirmation.  If we do this, we will tell you in writing and promptly refund any money you have paid to us.  In this case we, the Property Supplier and other Service Provider(s) (if any) shall have no liability towards you.

2. PAYMENT

For bookings more than one week prior to the start of the holiday, a deposit of 40% of the total cost is to be paid within 3 working days of our email/fax confirming availability of your select property. The balance must be paid the arrival date. Bookings received 1 weeks or less before your arrival date must be paid the arrival day.

3. CANCELLATION AND CHANGES

Cancellation must be communicated to us in writing (including by email and fax). The effective date of cancellation is the date we receive your written notification. The following cancellation charges apply:

30 day prior to arrival date - 90% of full deposit

In the unlikely event that we may have to cancel your booking for reasons beyond our control, we shall immediately try to locate alternative accommodation for you. Should that not meet with your approval, your deposit will be returned in full and there will be no further claim against us. We will not be responsible to pay any compensation following a change or cancellation by us, including any fees incurred in terms of other arrangements you have made with other providers.

If you wish to make changes or additions to your confirmed booking, you should notify this in writing to us as soon as possible, Costameiga will do its best to make the changes. However, we cannot guarantee that the Property Supplier(s) concerned will be able to meet any such request.

4. LIABILITY

We have a duty to select the accommodation providers with reasonable skill and care. We have no liability to you for the actual provision of the accommodation, except in cases where it is proved that we have breached that duty and damage to you has been caused. Therefore, providing we have selected the provider with reasonable care and skill, we will have no liability to you for anything that happens at the accommodation or any acts or omissions of the provider or others.

We also have no liability in the following situations:

Where the accommodation cannot be provided as booked due to forces beyond our control.
Where you incur any loss or damage that could not have been foreseen at the time of booking, based on the information provided by you.
Where you incur any loss or damage that relates to any business activity.
Where any loss or damage relates to any services which do not form part of our contract with you.
Where any loss or damage of any kind caused by wars, threat of war, threat or act of terrorism, natural disasters, riots, strikes, floods, storms, epidemic or pandemic illness etc., or by any event which constitutes ‘force majeure’
If we are found liable to you on any basis, we limit the amount we have to pay you to a maximum of twice the cost of your accommodation. This does not apply to cases involving death or injury.

5. INSURANCE

You must take out comprehensive travel insurance to cover you and your party against medical and additional expenses, cancellation or curtailment, public liability, personal accident, baggage and personal effects and personal money.

6. COMPLAINTS

In the event of cause for complaint you should first seek satisfaction locally through the proprietor of the property or his/her agent. If you are still not satisfied, contact Costameiga immediately by telephone and confirm the details of your complaint in writing to us while you are still in occupation of the property. You should then follow this up in writing to our office within 15 days of your return home. Costameiga shall have no liability for any claim which is not made within this period of time.

7. DESCRIPTIONS

Costameiga honestly believe that all statements made in their brochures and on their websites are factual and correct. Every reasonable effort has been made to describe the properties, their surroundings and to provide the amenities described. We cannot therefore be held responsible for any changes that became known after the brochures or website were produced, nor can Costameiga accept liability for happenings outside its reasonable control, such as breakdown of domestic appliances, wiring, building work, delays to travel services, weather conditions, invasions of pests, the property owner’s negligence resulting in loss, injury or accident.

8. GOVERNING LAW

These terms and conditions shall be governed by and construed in accordance with the laws of Galicia and Spain. It is mutually understood and agreed that any dispute, claim or any other matter that arises out of this contract on your holiday will be dealt with by the courts of Spain.

9. YOUR PROPERTY.

You can arrive at your property at any time after 5.00pm (unless advised otherwise, for example on your confirmation) on the start date of your holiday rental and you must leave by 10.00am on the last day.

If your arrival will be delayed beyond 8.00pm on the start date of your holiday rental, you must contact the person whose details are given on the confirmation information sent to you.

If you fail to do so, you may not be able to gain access to the property.

If you fail to arrive by 12 noon on the day after the start date of your holiday rental and you do not advise the person whose details are given on the confirmation information sent to you, your booking may be treated as having been cancelled by you.

No refund of any monies paid by you will be made in this situation.

Some Property Suppliers may require you to pay a security deposit on arrival.  If this applies to your chosen property you will be advised of the amount at the time of booking.  The security deposit will be refunded by the Property Supplier at the end of your holiday rental (less any costs for breakages, damage etc if applicable).

You and all members of your party agree both to keep the property clean and tidy and to leave the property in a similar condition as you found it upon your arrival.

You and all members of your party further agree not to use the property for any commercial purpose, including without limitation assigning or subletting it or otherwise allowing anyone to occupy it who has not previously been accepted by Costameiga on behalf of the Property Supplier.

You are responsible to the Property Supplier for the actual costs of any breakage or damage in or to the property - along with any additional costs that may result - which are caused by you and/or any members of your party, and the Property Supplier can require payment from you to cover any such costs.

The Property Supplier is entitled at his/her sole and absolute discretion to refuse to hand over to you, or to repossess, the property (which includes the fixtures, fittings, furnishings and decorations) if the Property Supplier reasonably believes that any damage is likely to be caused, has been caused or is being caused by you or any members or your party.

These circumstances will be treated as a cancellation by you. You also must not allow more people than the website states to occupy the property, neither can you significantly change the composition of your party during your occupation of the property, nor can you take your pet into the property unless this has been arranged in advance and is shown on your confirmation.

If you do any of these things, the Property Supplier can refuse to hand over the property to you, or can repossess it.

If the Property Supplier does so, this will be treated as a cancellation by you.

In these situations no refund of any monies you have paid in respect of your booking will be made and neither the Property Supplier nor Costameiga will have any liability to you as a result of this situation arising (including for example any costs or expenses you incur due to not being able to occupy the property, such as the cost of securing an alternative property/ accommodation or the payment of any compensation to you).

The Property Supplier or the Company will also not be obliged to find any alternative accommodation for you.

If you take a pet with you should not be left unattended in the property, and dogs should be kept on a lead within the boundaries of a property including the garden.

Registered guide and support dogs belonging to those with visual and hearing impairments are allowed in all properties offered by Costa meiga Ltd even where the property description states that pets are not allowed.

Customers with allergies should be aware that we cannot guarantee that a registered guide and/or support dog has not stayed in their chosen property nor can we accept any liability for any suffering which may occur as a result of such animals having been present.

You should also refer to the information regarding taking pets on holiday included in our website.

You must allow the Property Supplier and any representative of the Property Supplier (including workmen) access to the property at any reasonable time during your occupation of the property (except in cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time - in these situations the Property Supplier is entitled to enter the property at any time without giving you prior notice).
